Most Important
Key Articles Every Citizen Should Know
These articles form the backbone of citizens' rights in India.
Equality before Law
Part III
Whether rich or poor, powerful or ordinary — the law applies equally to everyone. No person, not even the President, is above the law.
💡 You and a government minister both jump a red light. The same fine must apply to both of you — Article 14 prohibits differential treatment.
Protection of Six Fundamental Freedoms
Part III
You have the right to speak your mind, write, protest, form groups, travel anywhere in India, and choose your career — subject only to reasonable restrictions.
💡 You write a critical article about a government policy. The government cannot shut down your blog for it — Article 19(1)(a) protects freedom of speech and expression.
Protection of Life and Personal Liberty
Part III
The most powerful article in the Constitution. No one can take away your life or freedom without following due process of law. Over 300 rights have been read into Article 21 by the Supreme Court.
💡 Police cannot keep you in jail indefinitely without following due procedure — arrest, produced before magistrate within 24 hours, right to lawyer. All guaranteed under Article 21.
Right to Education
Part III
Every child between 6 and 14 years has the fundamental right to free and compulsory education. Added by the 86th Amendment (2002). The RTE Act 2009 implements this right.
💡 A 10-year-old child is denied admission to a government school. Their parents can invoke Article 21A — the school cannot turn the child away.
Protection Against Arrest and Detention
Part III
If you are arrested: Police MUST tell you why. You have the RIGHT to a lawyer of your choice. You MUST be produced before a magistrate within 24 hours. These are not privileges — they are your constitutional rights.
💡 Police arrest you at 9 PM. They cannot keep you in a lock-up beyond 9 PM the next day without producing you before a magistrate. If they do, it is illegal detention.
Remedies for Enforcement of Rights (Right to Constitutional Remedies)
Part III
If any of your fundamental rights are violated, you can go directly to the Supreme Court. The Court can issue powerful writs — Habeas Corpus (produce the body), Mandamus (do your duty), Certiorari (quash the order), Prohibition (don't act beyond jurisdiction), Quo Warranto (by what authority?).
💡 Your family member is illegally detained. You file a Habeas Corpus petition under Article 32 in the Supreme Court. The court can immediately order the state to produce the detainee and set them free.
Fundamental Duties
Part IVA
11 duties every Indian citizen must follow. These are the other side of rights — you have rights, but you also have responsibilities toward your nation, society, and environment.
Superintendence of Elections — Election Commission
The Election Commission of India (ECI) is an independent constitutional body that conducts all elections. It is completely independent of the government and cannot be interfered with.
Proclamation of Emergency (National Emergency)
Part XVIII
The President can declare a National Emergency when India's security is threatened by war, external aggression, or armed rebellion. During Emergency, some fundamental rights can be suspended. Used in 1962, 1971, and 1975–77.
Power of Parliament to Amend the Constitution
Parliament can amend the Constitution — but it cannot destroy the "Basic Structure." The Kesavananda Bharati case (1973) established that the Basic Structure (democracy, federalism, fundamental rights) cannot be amended away.
